Testamentary Trust Plus
If you would like to ensure the future of your loved ones, particularly your vulnerable beneficiaries, then consider creating a Testamentary Trust. Our Testamentary Trust Plus enables you to appoint your Trustee(s) who will ensure your assets and loved ones are protected. The trust may be created using specific assets or portion of your estate, or your entire estate.
A testamentary trust is a trust created within and by your Will and only take effects upon your death. Your Trustee(s) will have several powers to help them manage your estate effectively for your beneficiaries’ future financial position. Moreover, they will have full discretion over who benefits under the trust and how the assets in the trust are invested.

We will help make sure your wishes and instructions have been detailed clearly and that your beneficiaries’ needs have been properly considered. HOW DOES IT WORK?
- ORDER: Select your State then click “Add to Cart,” verify your order then click “Proceed to Checkout.” Choose your preferred payment option—direct by credit/debit card, thru Xero Invoice, or a pay-later option thru AfterPay.
- CONFIRM: Check your inbox for the confirmation email and follow the instructions to download the information leaflet and questionnaire.
- UNDERSTAND: Complete the questionnaire and return it to AussieLegal via email.
- DRAFTING: AussieLegal will prepare the draft of your Testamentary Trust in consultation with you and according to your instructions.
- REVIEW: Once you are satisfied with the draft documents, we will send a copy to an independent law firm for review.
- ADVICE: Your respective estate planning lawyer will schedule a time with you to discuss your Trust and make further changes to the draft.
- SIGNING: Once you are satisfied with the draft documents, we will send you the finalised Trust. Print your Testamentary Trust and sign it before two (2) adult witnesses to be executed.
* Each assigned lawyer will allocate a limit of one (1) hour for preparation, independent legal advice through online resources or face-to-face, as well as written advice. Additional fees may apply if more time is required.
The time limit from the issuing of the first draft by AussieLegal to the issuing of legal advice by the advising law firm(s) shall be two (2) months. Additional fees may apply if the process is extended by the client(s).
