The AussieLegal Enduring Guardianship Assist (NSW) enables you to nominate your guardian when you lose the capacity to make your own decisions.

Our Enduring Guardianship is designed to comply with Guardianship Act 1987 (NSW). However, this service does not include legal guidance from an independent estate planning lawyer.

Although unnecessary, having legal guidance ensures all your wishes are properly considered in your Enduring Guardianship form. Moreover, consulting with an estate planning lawyer can ensure your form meets all the legal requirements to avoid potential disputes.

HOW DOES IT WORK?

1. ORDER: Select your State then click “Add to Cart,” verify your order then click “Proceed to Checkout.” Choose your preferred payment option—direct by credit/debit card, thru Xero Invoice, or a pay-later option thru AfterPay.
2. CONFIRM: Check your inbox for the confirmation email and follow the instructions to download the information leaflet and questionnaire.
3. UNDERSTAND: Complete the questionnaire and return it to AussieLegal via email.
4. DRAFTING: AussieLegal will prepare your agreement in consultation with you and send the first draft via email for review.
5. REVIEW: Thoroughly review the draft of your Enduring Guardianship form—AussieLegal will make further changes as required.
6. SIGNING: When you are happy with your form, print the final copy and sign it together with your appointed enduring guardian before an independent witness to execute your Enduring Guardianship form.
7. ACCEPTANCE: Give your Enduring Guardian(s) the acceptance form to sign and confirm their acknowledgement of the appointment. They do not need to sign at the same time with you or in front of the same witness.
