Description
Consent Orders
If you have reached an agreement on your financial settlement and parenting arrangements, then you may file an Application for Consent Orders. Our Consent Orders enables you to file your Financial Orders and Parenting Orders at the same time, through the same application.
Consent Orders are court orders that formalises your parenting and financial or property agreements—making them legally binding. It can be filed at any time after separation, but not more than 12 months after divorce. If you were in a de facto relationship, then file your Consent Orders within two (2) years from your relationship breakdown.
Our Consent Orders are fully enforceable in the Family Court and apply equally to de facto and same-sex couples. In addition, it already includes legal advice and certification from two (2) independent family law lawyers—one (1) for each party. Thus, ensuring your BSA is compliant with the Family Law Act 1975. Moreover, the Certificate of Independent Legal Advice is a requirement of super splitting regulations and for stamp-duty-free property transfers.
However, there is no guarantee that the advising lawyers will certify the proposed agreement and that the Court will accept your application. Moreover, in the event of extensive re-negotiations and re-drafting, the certifying lawyers may request reasonable additional hourly fees. You may see our Terms and Conditions page for more information about this matter.
