Description
Binding Separation Agreement Assist
Have you reached an agreement about dividing your assets and liabilities as part of your financial settlement?
Our Binding Separation Agreement (BSA) service is the least expensive way to formally document your agreement.
Commonly asked questions about BSAs:Â
Can I rely on a BSA?
Yes, if it is certified by 2 independent lawyers, it becomes ‘binding’ in the Courts.
Can a BSA be challenged afterwards?
Technically yes, but it is difficult and expensive to challenge a BSA once it is certified.
What are the most common circumstances where a BSA can be challenged?
- Non-disclosure of assets and liabilities.
- The agreement is not fair and equitable. The duty of the certifying lawyers is to make sure the agreement is fair and equitable. Otherwise, they will not certify it.
Can I use my own document? Will it save some money?
That is OK. We will use your document and extract the facts and details, but we, and our panel of law firms, want to use our tried-and-tested agreement that they use. We will offer a $100 discount if you have your own document to start with.
However, the BSA Assist does not include legal advice and certification to make the agreement ‘Binding’ and enforceable in the Family Court—we assume you have your own lawyers. If you do not have a lawyer yet and prefer getting the complete BSA package, then you may want to consider our Binding Separation Agreement Plus.

Should you decide to change your lawyers, you may want to consider upgrading to our Binding Separation Agreement Plus. Our BSA Plus will give you and your partner/spouse access to legal advice and certification from two (2) independent family law lawyers—one (1) for each party. Thus, ensuring your BSA is compliant with the Family Law Act 1975 and Family Court Act 1997 (WA de facto). In addition, the Certificate of Independent Legal Advice is a requirement of super splitting regulations and for stamp-duty-free property transfers.
