Description
Binding Mutual Wills Plus
If you are planning to marry or enter into a de facto partnership and have children from a previous relationship, then you may want to consider creating mutual wills with your new partner. Our Binding Mutual Wills (BMWC) Plus enables you to make specific provisions for your new spouse or partner, whilst ensuring your children from your previous relationship are the ultimate beneficiaries of any property written into the Will.
Mutual Wills are created at the same by both parties and are made binding by a second document—the Binding Wills Contract (BWC). The BWC contains directions about both parties’ individual Wills and prohibits either party from changing or revoking their Will without the consent of the other.
If a party to the BWC dies, both Wills become irrevocable, and the surviving spouse or partner will have a legal obligation to ensure the deceased party’s assets are distributed according to their Mutual Wills. This means the surviving party to the BWC cannot deal with the deceased estate in breach of the contract.
The AussieLegal BMWC Plus service includes legal advice from experienced estate planning lawyers for you and your new spouse or partner. Thus, ensuring that your individual Wills have been thoroughly reviewed and that you both understand and agree to the terms of your BWC.
