Description
Binding Financial Agreement Plus
Have you reached an agreement about how your assets and liabilities will be split in the event of separation?
Our Binding Financial Agreement (BFA) service is the least expensive way to formally document your agreement.
Commonly asked questions about BFAs:Â
Can I rely on a BFA?
Yes, if it is certified by 2 independent lawyers, it becomes ‘binding’ in the Courts.
How long does the process take?
Usually around 3 to 4 weeks.
Can a BFA be challenged afterwards?
Technically yes, but it is difficult and expensive to challenge a BFA once it is certified.
What are the most common circumstances where a BFA can be challenged?
- Non-disclosure of assets and liabilities.
- The BFA is unfair on the welfare of the children of the relationship.
- The agreement is not fair and equitable. The duty of the certifying lawyers is to make sure the agreement is fair and equitable. Otherwise, they will not certify it.
Can I use my own document? Will it save some money?
That is OK. We will use your document and extract the facts and details, but we, and our panel of law firms, want to use our tried-and-tested agreement that they use. We will offer a $100 discount if you have your own document to start with.
