If you ex wants to have the house in their name and remorgage the house but you ask for a cash settlement and they can't get a loan for that amount are they able to access their super to pay you out?

Generally they wont be able to withdraw from their super and pay you out in cash ( it will be taxed if allowed - let it be their problem if so ).

Generally super can be transferred to you if you agree, NOTE: You will not be able to access the super transfer as cash - it will remain in your super fund until such time you retire ( or have age access )

Best to get cash.
